Belgrade Legal Theory Group organized its second event of the autumn semester of 2023 with Prof. Brian Tamanaha (Washington University) on the topic of sociological approaches to jurisprudence.
Prof. Tamanaha opened with general remarks about pragmatism, with a focus on its core meaning. He stated pragmatism concerns itself with experience and action, i.e. with what law does, how people perceive it and what real social consequences of the law are, while designating law as a set of social institutions that evolve over time in a layered context. Pragmatism also relies on evolutionism and perceives all human conduct as part of the natural world, making it compatible with naturalism. On top of that, it accepts only beliefs that are reliable and verifiable, although scientific theories are not ...

It occurs in the gray zone of planning and construction, somewhere between legal and illegal, formal and informal, and everywhere across the region. From the outside, it is often perceived as exotic and wild, a must-see when on urban safari in this peculiar part of Europe. At the same time, the local mainstream narrative points the finger at the individuals and portrays it as a transgression of those traditionally perceived as “newcomers”, refugees or gastarbeiters. The world is divided on marijuana legalization. Numerous studies have shown that it helps in reducing symptoms of some of the most fatal illnesses, which is why cannabis oil has been legalized for medical purposes in numerous countries across the globe.
While a public debate on legalization is going on in many more countries, in Serbia any possession of marijuana is illegal. Arrests of people with illnesses, as well as their family members, have been made. And yet, more and more people are buying the oil illegally.
Vice Serbia speaks with some of these families who wished to hide their identities, fearing the Serbian authorities. We spoke to the head of the group within the Ministry of Health who is strongly against legalization. We also meet a dealer who is willing to cook the oil on camera.

Belgrade Legal Theory Group organized its second event of the autumn semester of 2023 with Prof. Brian Tamanaha (Washington University) on the topic of sociological approaches to jurisprudence.
Prof. Tamanaha opened with general remarks about pragmatism, with a focus on its core meaning. He stated pragmatism concerns itself with experience and action, i.e. with what law does, how people perceive it and what real social consequences of the law are, while designating law as a set of social institutions that evolve over time in a layered context. Pragmatism also relies on evolutionism and perceives all human conduct as part of the natural world, making it compatible with naturalism. On top of that, it accepts only beliefs that are reliable and verifiable, although scientific theories are not necessarily eternal and unchangeable. Prof. Tamanaha quoted J. Dewey, saying a pragmatist rejects the abstract, a priori, universal truths. Naturalism, in the same manner, points towards contextualization and variations of human relations, but at the same time – some proponents outline similarities among societies based on common human traits. They emphasize natural, biological aspects of human life that lead to the creation of societies and even instinctive moral intuitions.
Prof. Tamanaha then moved on to analytical jurisprudents, who, on the other hand, do not agree with the pragmatist approach, since they focus on universally true features applicable to every society. He gave an example of J. Raz’s assessment of the philosophy of law as dealing with necessary truths about law and its essence, with a tendency to assume truisms and even extend analytical arguments about law to non-human societies.
Afterward, Prof. Tamanaha moved on to a comparison between historicism and holism, as well as general notions of social constructionism.
Following was the Q&A part of the event, with substantial interest from the audience that was mainly focused on the potential place and role of analytical jurisprudence and conceptual analysis in our attempts to understand what law is, as well as conventionalism and problems with our attempts to understand law in past societies through contemporary lenses.
Ending the meeting, Mila Đorđević thanked everyone for an excellent discussion, as well as Prof. Tamanaha for the interesting lecture.

TAMING THE WILD addresses the widespread extra-legal building practice, a spatial phenomenon widely spread across Belgrade and the Balkans. It occurs in the gray zone of planning and construction, somewhere between legal and illegal, formal and informal, and everywhere across the region. From the outside, it is often perceived as exotic and wild, a must-see when on urban safari in this peculiar part of Europe. At the same time, the local mainstream narrative points the finger at the individuals and portrays it as a transgression of those traditionally perceived as “newcomers”, refugees or gastarbeiters. Through different research practices, the research focuses on demystifying this spatial phenomenon and the myths that feed it. A mandatory step in building a better space and a society.

The war in Ukraine has raised political tensions throughout Europe – but notably between Kosovo and Serbia. In Brussels, officials have told both sides to cool their rhetoric and warned Kosovo that without an agreement to normalize relations with Belgrade, the time for joining the EU is running out.
Kosovo Prime Minister Albin Kurti says Belgrade is destabilizing the Balkans through “illegal structures” and Serbia’s relationship with Russia includes military, economic, and intelligence ties. What hope is there of an agreement between the two sides before the European Union’s deadline of May 2024? Speaking to DW’s Tim Sebastian from the capital Pristina, Kurti
claimed his country is the democratic success story of the Western Balkans. But what about the corruption, discrimination, and the harassment of journalists? And, more than 20 years after the conflict in Kosovo, why are 1000 war crimes cases still pending?
